I heard about this the day everyone was talking about the Etika JoyCon C&D, I'm glad you covered this Armada. I really dislike Nintendo at this point because the extent that they're out of touch with their fanbase, especially the older ones, like Maximillian Dood, or even the competitive scene (even though they claim to hate competitive play) is astounding.

Nintendo's law department(s) are clearly on a warpath. Protecting your copyright is an essential aspect of keeping them, of course, so I don't want to pretend Nintendo has no reason for doing things.
But in general, many of these things are situations where this is no dialogue, no alternative, and no kindness to the fans. The fans want to play their games online, enjoy tournaments, listen to the soundtracks, and participate in fan communities. Nintendo has shut these down systematically for not functioning in the exact way they want. I remember them advertising literally using your Switch as a portable music player for Smash Ultimate, which they did instead of just putting the music on Spotify. Even Square-Enix, a notoriously closed-off company, has started adding their OSTs to Spotify and other streaming services, or online music stores. Nintendo simply never offers alternatives for gamers.
The reality is that channels like GilvaSunner's or Melee tournaments using Slippi aren't costing Nintendo money. They aren't siphoning profits. They are the community expressing themselves and enjoying Nintendo content old and new. If there ends up being a concern vis a vis legality, Nintendo could open a discussion and figure out what the solution is. Melee players could verify using ROMs they copied from their discs to prove that their use of the emulator was legal. Nintendo could put their music into a legally accessible form that earned them revenue. They could put games back up for purchase on some kind of Virtual Console like they had before. Nintendo could discuss proper and valid revenue share with content creators if there were concerns. Most content creators I follow would rather negotiate and discuss a deal to be able to make content than simply not.
At the end of the day, the ball is always in Nintendo's court. But they make money regardless, so they take the simplest legal recourse available to them and do something that upsets everyone. It doesn't seem to matter to them. So here we are.

The worst thing about all of this is that they know they can get away with all of it. I’m not even talking about legality, when all is said and done, Nintendo’s still gonna be raking in the cash regardless. There’s only one smash ultimate, one splatoon 2, and so on. Not even mentioning the Twitter mob that’s foaming at the mouth waiting to screech about how Nintendo is still completely perfect. Nothing will be done, and they’ll carry on like nothing happened. You can’t kill Mario.
