Answer 2: The disposition of public art and public spaces should not be settled by mob action. There has been a recent surge in removal of statues of historical figures with a contentious past. As part of the ‘Black Lives Matter’ protests seen in the United States, a number of statues of controversial figures including that of Christopher Columbus as well as various confederate generals have been toppled. In the UK, a similar trend has been noticed in the removal of statues of slave owners and controversial colonial figures such as Edward Colston.

Columbus was without doubt a man of enormous flaws who behaved with great cruelty. But Columbus was also a mariner of incandescent skill, and he propelled the human story forward as few men or women ever have. All great men and women fall short of perfection, especially when scrutinized by the standards of later eras. But that doesn’t mean the public square must be stripped of any statue or tribute to someone who was flawed. We can acknowledge their blemishes without denying their greatness.

History’s verdict isn’t immutable, and society is entitled to change its mind about whom to celebrate. But that verdict should be rendered by the people, acting through their government. There is a modernist urge to wipe away the past and replace it with the new, but we should resist it. The battle isn’t won by taking the statue away and pretending those people didn’t exist, it’s won by empowering the people to look up at statues with a cheery and self-confident sense of indomitability.

Ans 1:. The National Green Tribunal (NGT) is a specialized body formed under the NGT Act, 2010 for effective and expeditious disposal of cases that are related to protection and conservation of the environmental, forests and other natural resources.

The objectives of the Tribunal:
• Effective and expeditious disposal of cases related to protection and conservation of the environmental, forests and other natural resources.
• giving reliefs and compensations for any damages caused to persons and properties.
• handling various environmental disputes that involve multi-disciplinary issues.

The mandate of the Tribunal:
• providing a way for the evolution of environmental jurisprudence through the development of an alternative dispute resolution mechanism.
• helping in reduction of the litigation burden on environmental matters in the higher courts.
• Delivering a faster solution for various environment-related disputes that are less formal and less expensive.
• curbing environment-damaging activities. NGT ensures the strict observation of the Environment Impact Assessment process.
• Dispensing reliefs and compensations for any damages caused to persons and properties.
• resolving various civil cases under the following seven laws that are related to the environment:

Structure of NGT:
• The tribunal comprises of the chairperson, the judicial members and expert members. they shall hold office for 5 years and are not eligible for reappointment.
• the chairperson is appointed by the central government in consultation with Chief Justice of India .
• A selection committee formed by central government to appoint the judicial members and expert members.
• There are to be at least 10 and maximum 20 full time judicial members and expert members in the tribunal

1.Symbols like statues show collective achievement of a personality which may be interpreted differently with respect.
changing context of time.
2. Moderate path is always better.
3. George 5 statue was not destroyed but removed as per the demand of public opinion.
4. Hate towards material objects is a mere showcase of frustration in its uncontrolled form but this fruitless.
5. Breaking statues is no solution to any problem. Yes the idea represented by any symbol can be criticised .

Due to the Outbreak of protest for the oppression of Black peoples statues of various historical figures were toppled.First of all we have to understand that the statues are kept as Heritage symbols.But the Heritage of the statues were decided by collective decision of the society not by the Judgement of the person's contribution to the society.Here the collective decision of the society directly Reflects the ongoing politics of the society.But its a wrong path Every person in the today's heritage symbol is not a perfectionist and led a Perfect life.For example Gandhi is Not Mahatma when he was born.He also have prejudice that was imposed by the Society as like every common man.As alleged he is also a Biased man and a loyal barrister to British.But as the time runs off, He realised the Mistakes and Disowned his Past and even he inspires Martin luther king and Nelson mandela.So we should Judge a Historical person with his overall contribution to the society.Toppling statues should be done with the concern of public conscience and with a Public debate.We should understand that heritage is the reflection of the history and history is the collective life not a single segment of a person.

ANS 1. National Green Tribunal is a Statutory, Quasi - Judicial body established under the National Green Tribunal Act 2010.
The purpose of its formation is speedy redressal and disposal of environment related cases.
It was formed in order to provide citizens the Fundamental Right ie; RIGHT TO HEALTHY LIFE that comes under Right to Life.

Mandate of NGT -
1. To ensure growth as well as conservation of the environment.
2. Environment protection, Conservation of Forests and Natural Resources alongside economic development.
3. Providing justice to the victims of environmental damage.
4. Disposal of appeals and applications within 6 months of filing.
5. Guided by the "Principles of Natural Justice".

Structure of NGT -
1. Chairperson - RETIRED JUDGE OF THE SUPREME COURT.
The Chairperson is appointed by the CENTRAL GOVERNMENT after consultation with the CHIEF JUSTICE OF INDIA.

2. JUDICIAL MEMBERS and EXPERT MEMBERS.
They are appointed by a SELECTION COMMITTEE which is formed by the CENTRAL GOVERNMENT.
A Minimum of 10 and a Maximum of 20 members can be selected by the committee.

3. The tenure of the above mentioned is 5 years and none of them is eligible for re-appointment.



ANS 2. Statues are the repository of civic memory, acknowledging the great and the good deeds that built the society and therefore they hold such a great importance for every upcoming generation.
Statues are heritage symbols which represent the collective identity of the society which may be subjective.

Recently, during the Black Lives Matter protests statues of many controversial figures such as CHRISTOPHER COLUMBUS who brought oppressive colonialism in North America and CONFEDERATE LEADERS who treated blacks as slaves in the USA and the British slave trader EDWARD COLSTON in UK have been toppled because these statues glorified the figures who have oppressed and tortured people on the basis of color in the past.

Need of the hour -
1. Having public debates and discussions before removing the statues.
2. Preserving or removing of a statue must depend on the shared judgement of his contribution to collective life and not just a part of it.
3. Evaluation of the heritage symbols from an ethical prism and creating heritage symbols such as the Holocaust Memorial in Germany and Vietnam Memorial in USA, which do not glorify these historic events rather seeks to tender public apology for the misdoings.

It is justified that the statues of such figures must not be glorified but knocking them down won't rectify the problem either. It rather erodes the fight of the oppressed against the oppressors.
A great example can be taken from INDIA when the statue of George the Fifth was removed by public debates and discussions, signifying that there is no place for Monarchs and Dictators in the country.

Q- Write a note on NGT with special emphasis on its mandate & Structure?(250 words/15 marks)
Ans- NGT was established as Quasi-Judicial body in 2010 under NGT Act 2010 for speedy disposal of environment related cases of protection, conservation forest & natural resources. Draws inspiration of Article -21 assures Right to healthy environment under Right to life .It is a specialized agency with expertise of handling multidisciplinary issues of environment disputes to foster Principles of Natural justice and not guided by Code of Civil Procedure 1908.It has mandated to Dispose cases within 6 months of filling & principle place of sitting of the tribunal is in New Delhi with 4 other places of sitting at Bhopal, pune, Kolkata, Chennai .It follows Circuit procedure for making itself more accessible .

Structure of NGT—

1. Composition of Tribunal having Chairperson, Judicial members, Expert members who holds office for a term of 5 years and lacks reappointment.
2. Chairperson appointed by Central Govt in consultation with CJI.
3.judicial and expert members are appointed through a selection committee formed by Central Govt.
4.Minimum members-10 & maximum members 20 full time judicial & expert members .

Unfortunately the govt did not appoint sufficient numbers of judicial & expert members until now which is very urgent in the perspective from NGT to speedy disbursal of litigations and sensitive ecological and environment point of view.
