Your children are in foster care, what are you going to do? Hi, my name is Vince Davis and I'm an attorney here in California. I've been an attorney for over 30 years and I'm an expert in juvenile dependency cases, more commonly known as CPS or DCFS cases. So your children are in foster care, what do you do? I'm going to tell you a secret, I'm going to tell you one way I use to get children out of foster care and at least placed with friendly relatives. The law states in Section 309 of the Welfare and Institutions Code that the social worker is supposed to be doing an investigation within 30 days to have the children placed with an appropriate relative or nephron, -- a non-family member who's an extended part of the family, or a family friend. So what I have my clients do is I have my clients make a list of family friends and relatives who could take the child. Now, I didn't say would take the child, I'm not asking you to call anybody. Just make a list of people who could. These family members and family friends do not have to live in your county, as a matter of fact, they can live in another county inside California, they can live in another state in the United States or they could live anywhere. That's right, anywhere in the world. So if a social worker tells you, "We can't place with your relatives because they live in Florida," that's not true. The department has to do a search. Now, it's a lot of work to do a search and to evaluate a relative. And if you give them 25 names, the names, the addresses the telephone numbers, the emails, and the relationship to the child, aunt, great-aunt, great-grandmother, family friend, the social worker has to perform an evaluation and report back to the court whether the child should be placed with this relative. You know, if you have children in foster care, act now, do not wait try to have these children placed in relative care, or with a family friend down the line in the case. It may not work as strongly. I always tell people that you can get children placed with relatives or family friends early in the case. But as you wait, your chances of that happening decrease as time goes along. So don't wait, get your list together, email it to the social worker, give it to your attorney so that the attorney gives it to the county council, and let's get these investigations going to have these children placed. There's one thing I want to tell you, a lot of times when I do this, I get back the excuse, "Well, we can't place with grandma because she hasn't passed the ASFA test, she hasn't been evaluated. And that is a legitimate reason. However, the court has the power to bypass that and place the children with the grandmother even though she hasn't passed ASFA, even though she hasn't taken all of her classes, as an emergency placement.
And one of the conditions for that placement with Grandma will be that she continues through the ASFA process and go to the classes. But don't let that stop you from getting the children placed with the relative right now.

There is no law in Washington that is followed concerning children with exception to making money on them and their families. Since when is a government worker supposed to adopt A grandchild from her grandparent and sister? And where she has been residing for one year without complaint? Especially when that grandparent has raised her older sister through CPS from a nearby county and it is written in all the paperwork that that grandparent is to be the adoptive person for the younger Child? The grandparent being a Councilwoman second term in her city? No record of any kind? Owning a beautiful home? Not in Stevens County Washington. It’s corrupt. Then after the grandparent is coerced by a A psych evaluation that could take both children, surrendering the youngest to save the oldest Who is in her custody and who they would have to prove whatever, and with a free attorney from the state, not given for a foster parent of which I was made, well the grandparent, me, is appealing, her appeal is sent back giving time for the child to be adopted, the appeal considered moot, and then the grandparent is sent a video showing the grandchild stating, “my daddy walks in my room with no clothes on hee hee. “ And no one does anything about it. This is what happens where Washington state is concerned. Look up Senator Nancy Schaefer who lost her life. Look up Senator Pam Roach, now a Councilwoman. Get the book called remembering Cynthia Rose at your local library. Our prosecuting attorney had so many files on his floor he could barely walk through his office. He tried to fight it. Representative Joel Kretz and senator Shelly short tried to fight it to no avail. The state ombudsman fought for everyone to no avail and had their stats thrown up in court not recognized. The area CPS supervisor went to court for me and fought, that particular county going against her as well! My own temporary attorney didn’t file my de facto petition and later said I should have filed it. He still got paid. Yes I’m a little bitter because I miss my granddaughter desperately. Her mother, my daughter was allowed to keep her other children if she signed the adoption papers and later got cancer and nearly died. She’s free of cancer today but for how long? These people hurt and destroy and disintegrate families. They must be put out of business. They are a huge entity full of pilot programs and workers, judges, drivers, attorneys, state attorneys, guardian ad litem‘s, social workers, psychologist, psychiatrist and more. It’s big business and they won’t give up their unions which means they cannot be fired! They can only be transferred! If you want to stop socialism this is where it begins. No one is safe who has a child or a grandchild. No one.

We determined that even if we prevailed against these low lifes, it would take so long through legal channels that the kids would be grownups before we would see them again.
Rather than let strangers raise our kids, we packed therm up and fled to the other side of the country, where we raised them openly, under our own names. When they were too old to market, we brought them home and finished raising them here.
Today the youngest is thirty something.

Thers no way out of this horror. I wore out / down had a paid lawyer they told me to take a plew deal. I have finished my case plan even got my son in counseling. When I asked for reunification thy keep continuing court dates & now telling me to keep the same case plan wanting me to do visits a 3rd evaluation when I've done the highest level of evaluation possible I forensic physcological eval. Basically if we don't do what thy say or want even when thy broke civil rights have a lawyer etc.... Thy take your kids & your stuck it's the worst nightmare I've ever endured.

I read the comments and people are not understanding the point of this video. The point of this video is to empower parents and family members who are fighting CPS that family law is above CPS and what the social worker and CPS will and will not do. This is why you need to study and understand the law then work with an attorney to fight to get your child placed with a family member or friend. Time is of the essence here. I actually took the advice in these videos and worked with my attorney to make action. Otherwise, you will be screwed. I am not better than anyone else, it’s just more frustrating if you have no idea about the law and the process, so it’s best you educate yourself.

Vincent I could only wish I could have had some insight that give in your videos.For some reason I can't e-mail you or anything in reguards to fathers rights. My son was taken sua asponte and DCF is not following protocal or state statues like a family find or. Allowing representation in a placement review hearing. If you could help with any information on how to stop my ability from presenting my case and accomplishments due to sua asponte because as u know all control now falls on the court and makes no sense to the equal justice and protection act that is a big part of the justice system. Maybe I m just naive and not being lawyer is my downfall but I love my son and always been an active father in all aspects of his life and if you were to return my message would be more than I could ask for as I do still believe in the adjudication process just not some of the players who have influence and changed the direction and statues in place so a child and parents won't go through such of a damaging way of a modification to custody case were my only intent was bettering my sons life with two better parents and not one only to have now nobody and a CPS system who is looking out for there best interest in a series of crossed lines and keeping me from getting it out.
