That’s Tim Drake. Jason Todd was already being tortured during Arkham Asylum. And joker even says in Arkham City “Robin? Didn’t I kill you already?” Obviously referring to when he shot Jason Todd.

In the batman games there's another time you can kill goons. In Arkham asylum in the botanical garden there's a gap where you can only get acrossed with the zip line and there will be goons there at some point and if your on the other side you can batclaw them into the abyss
