What do I have to prove to make an Amazon Flex Claim? | California Personal Injury Lawyers

If you're making an Amazon Flex claim, you have to prove that the driver was in the process of actually delivering packages for Amazon if you want to hold Amazon liable.

Like I discussed before, if you're in an accident with an Amazon Flex delivery person and your accident exceeds the value of their private insurance policy. Let's say they carry an insurance policy of the California state minimum of 15,000, and your accident is worth 50,000. Then you're going to want to make sure you can prove that they were in the process of delivering packages for Amazon in order to get Amazon on the hook for anything over the driver's personal insurance of 15,000.

In order to do that, you would do what we do in our Uber cases, for example, and check the status of the driver's app. The Amazon Flex app will have record of when this person logged in, when they logged out, whether they were in transit, whether they had already just dropped off a package and were done.

That's really how you do it. You don't always get that information right upfront, so I would encourage you to contact a personal injury attorney who's had experience with these types of cases so that they can dig in for you and get the app history and the information you need to prove that they were indeed working for Amazon at the time of the accident.
