Is KitKat a wafer or a chocolate?

Nestle always classified KitKat as a wafer, as the tax on chocolates is 20% while the tax on wafers is 10%. Central Excise Authority thought this was a strategy of Nestle to avoid tax and they investigated the same.

They visited Nestle’s office in Delhi and one of their factories in Goa and finally sued Nestle for falsely classifying KitKat as a wafer. But the court was in favor of KitKat and accepted that it falls under the wafer category.
