UK Immigration cover letter
In this video we discuss the following questions:
1. Should you include a cover letter with your application?
2. What should be in the letter and how should it be presented?
Cover letter needed or not?
A cover letter is a document that presents your application to the caseworker. It is not usually necessary, but very important if your case needs an explanation or you do not meet some of the visa requirements the usual way.
You can pause the video to read some of the slides.
Since the Home Office went digital, online application with pdf supporting bundles and auto generated document checklist, the need for a covering letter has gone down significantly. You can also add additional information towards the end of the application form itself to explain some things to the case worker.
So the short answer is, if you meet all the requirements in the usual way and there is no need for explanation then it will be preferred that you add a short cover letter but can do without.
If you do not meet some of the requirements the usual way or are seeking to rely on exemptions or alternative ways of meeting the requirements, you must present your case. As otherwise the case worker may not fully grasp what is going on and how you propose to meet the requirements. This is important during the current Coronavirus pandemic. You may not have all the required documents as offices may be closed or documents provider unavailable.
Cover letter
The cover letter should take the form of a formal letter.
It should be concise, precise and unambiguous. This means you try to keep your letter 1.5 to 2 pages long.
Human rights or private life letters can run on for 5-8 pages. Ideally, the letter should be divided into several paragraphs with headers listing requirements and how you meet them.
As a guide, paragraph one, should state what the application is for, at what stage you are at and what you want the caseworker to do.
Example of paragraph one.
I am making this application for Leave to enter as a Parent of a Tier 4 child, as my son is studying at a privately funded UK independent school. I would like to accompany him to the UK.
Or
I am making this application to extend my leave to remain as a spouse of a British national, we continue to meet all the requirements as outlined below. I have made UK my home for the past 3 years and require the leave to remain to be with my partner and child.
Then, you should have a paragraph just briefly stating your background information.
I am an American national, I came to the UK on 10th November 2014. I was granted a 30 months spouse visa for the UK. I successfully extended my visa in 2017 and the same is due to expire on 15 August 2020. I am now applying for ILR as the next stage in my 5 year route to settlement.
Next, you should go through each item from the requirements, paying more attention to items where you do not meet the requirements in a straight forward manner.
If you have patchy residence evidence as you or your partner do not pay any rent or council tax as you live with your in-laws. Or had a flooding which destroyed all your letters from 2017 to 2019. Or you have a medical condition which means you will never be able to pass the English tests and your doctors have completed the KOLL exemption form.
Or other things like, missing relationship documents for partner or child, had some trouble with the police and need to present the facts. Or you will furnish some documents at a later date, in this case you should try to be precise as possible and actually provide the document as agreed.
If you have a complicated work arrangement, explain – so you work for A, but B, an employment agency pays your salary and you are stationed at location C, a department store and finally your payslips are produced by head office based at some remote location in north of England, which some reason appears as your employment address on your payslips.
It is advisable to be concise and precise, so avoid long sentences, collect all the relevant information and present it in this one document.
Once you have gone though the various requirements and how you meet them, you can then conclude the letter with a summary and invite the Home Office to write to you if further documents are required to arrive at a positive decision.
Finally thank them and sign off.
Remember, identifying risks and trying to provide an explanation and supporting evidence increases your chances of success. Ignoring problems usually makes the problem bigger, the Home Office is not just an agency, it can make or break your future.
Be polite and not to heavy, you want something, for the caseworker it is just another file they need to consider, as part of their job. Nothing more. Make their life easy by presenting a good cover letter which takes them smoothly through your case bundle.
