Can I File Bankruptcy with a Power of Attorney?

The answer to whether you can file a bankruptcy for another person if you have a power of attorney for them really depends upon the language of the power of attorney documents. Usually, the specific language of "bankruptcy" must be included in the document.

Who attends the 341 Meeting? Section 341(d) states that "... the trustee shall orally examine the debtor..." Bankruptcy Rule 4002 also specifies that the debtor shall attend and submit to an examination.

I ask because of a situation where the debtor is terminally ill.
