Why the Ohio Supreme Court won't stop hating on Boneless Wings

The Ohio Supreme Court became the butt of many jokes when they made a ruling on a case involving the risk of bones being found in "boneless" chicken wings earlier this year. Their ruling was that "boneless" is a cooking style and there is a foreseeable risk you would find bones in your tendies.

Since then, the party that lost asked for a reconsideration of the arguments, but they refuse to do so....even when society (and themselves it appears) know they are incorrect.

The more aggregious thing is that boneless wings are both not (necessarily) boneless, but they're also not even wings. They're a total lie.

In law you have to use the common understanding of the word, yes? The common understanding of the word BONELESS, would be as below, #2...

Because of the industrial way all of the meat is deboned, the regulators would have to have some sort of variance for them to use the term boneless. If it wasn't for those terms being centrally regulated, then the common understanding would have been able to go to court.

I want to know how he missed a 2" bone while cutting up his big boy tendies, and how did he manage to not notice it before swallowing (ever hear of chewing?). This sounds like he set it up.

Restaraunt: Cannot verify no bones unless they destroy the product
Distributor: Cannot verify no bones unless they destroy the product
Manufactuer: Verifies no bones with an x-ray machine

The only reasonable liability is the manufactuer, and they take reasonable steps to ensure no bones get through.

I'm scratching my head here as how can you advertise "wings" with no bones in them? I have no idea on the case but having wings with no bones in them is a strange thing to offer.

What could this do to defamation suits? "well yes he said he was dickless moron but that does not mean one should be suprised to find he has a dick" or could teh reverse apply "yes he said he was a p*** but that does not mean one should be suprised to find he is not a p***"

Well fat free is only free compared to other similar products. I sorta get it. Wings usually do have lots of bones, so boneless necessarily implies that the bones must've been removed. No process is perfect, some residual sometimes gets through, so boneless might sometimes be adulterated. Similar to all the regulations that define how many bits of bug are permissible in a case of yogurt cups. Bugs are not yogurt but it happens nonetheless
