From the 1991 tax case..
McVitie's argued that Jaffa Cakes are cakes because they have a sponge-like texture, harden when stale, and are made from a thin batter of egg, flour, and sugar, similar to cake batter. To demonstrate their point, McVitie's even baked a giant Jaffa Cake for the court case. The tribunal ruled in McVitie's favor, and Jaffa Cakes are now considered cakes for tax purposes and are exempt from VAT.
In this case, the cake was not a lie.

Jaffa Cakes went to court with a giant Jaffa Cake to prove it was a cake.

Tariffs are higher for luxury biscuits than for cakes.

It’s called Jaffa Cake because of the sponge under the jelly. Savoiardi sponge fingers are the same. Ever had Tiramisu? Savoiardis are used for the cake base. They look like biscuits because they’re dry sponge, but the become cake when moistened. Biscuits do not, they collapse.

Fun fact: in french we call Jaffa cakes "pims", which made for funny misunderstandings when I was living in the UK 😂

When cake goes stale they go hard, when biscuits go stale they go soft. Jaffa cakes go hard, therfore its a cake.

a biscuit is something that you can break apart with a snap and has a crumble biscut base.

a jaffa cake is basically a small cake.

In Finland they are called biscuits, fun fact: we also have over 10 different Jaffa cake flavours such as raspberry, lime, tuttifrutti and coca cola
