Montana Attorney General faces 90 day suspension recommendation

Early in October, a hearing before the state’s Commission on Practice reviewed 41 counts of professional misconduct against the state’s Attorney General.

On Wednesday, the panel recommended suspending Republican Austin Knudsen from practicing law for 90 days due to violations of professional conduct rules during a legal dispute between the Montana Legislature and the judicial branch. The panel found that Knudsen’s actions, defying court orders and making incendiary remarks about judges, were egregious and detrimental to the justice system.

In the recommendation, the panel emphasized that no attorney, especially the chief legal officer, should attack the integrity of the judiciary without facing consequences. Knudsen’s office plans to appeal the recommendation, and the Montana Supreme Court will ultimately decide on the matter. If suspended, it could affect Knudsen’s ability to serve if he wins reelection in the upcoming election.
