Step 1. Grounds for Divorce

When you apply for a divorce, you must prove that your marriage has broken down by selecting one or more of the following five reasons:

• Adultery – Your spouse has had sexual intercourse with another person of the opposite sex.
• Unreasonable behaviour – Your spouse has behaved in such a way that you cannot reasonably be expected to live with them, such as physical or verbal abuse, lack of sex, financial recklessness or a lack of socialising.
• Desertion – Your spouse has deserted you for a continuous period of more than two years.
• Separated for two years with consent – You both agree to the divorce.
• Separated for five years with no consent – You do not need your spouse’s agreement.

Step 2. Filing for Divorce

Your wife will be sent a copy of your application and an acknowledgement of service form, which asks if she intends to defend the divorce. She must respond within eight days. If you named the person your wife committed adultery with, they will also be sent a copy of the application and be asked to respond.

Apply for a Decree Nisi

You can apply for a decree nisi if your wife does not defend your divorce petition. A decree nisi is a document that states that the court does not see any reason why you cannot divorce. You can still apply for a decree nisi if your wife does not agree to the divorce, but you will have to go to a court hearing to discuss the case, where a judge will decide whether to grant you the decree.

If the judge agrees, the court will send you and your wife a certificate, which will tell you the time and date you will be granted a decree nisi. Once received, you must wait 43 days (six weeks and one day) before you can apply for a decree absolute to end the marriage.

Apply for the Decree Absolute

The decree absolute is the legal document that ends your marriage. You need to apply within 12 months of receiving the decree nisi; otherwise, you will have to explain the delay to the court.

Once you have received the certificate, you are officially divorced.

Hi I had domestic abuse I have reported him to the police for the abuse. I have been in refuge for a year and separated for more then tow years do I need to prove all this to make the divorce quicker?
I olso don't want him to know the city where I live would the court share that with him ?
