The reason there is no Orange toad is due to the fact that orange toads have ONLY appeared in the Paper mario franchise, and never elsewhere, so they probably didn't consider it mainline enough to include.

From what I've gathered, the ONLY mainline Toad colours we're missing are Pink toad, and red toad with a red outfit (As opposed to the blue he's commonly depicted in)

The reason Toad's chair is loose is so you can use Lakitu's fishing hook to lift it and kidnap him to the small tower.

I find it interesting that the original Mario starter course had a specialized base for the goal pole and then no other set since then has used it.
