Adv Mngomezulu is correct to remind the Judge of its position, therefore, he CANNOT DECENT TO THE ARENA.
The arguments are between the 'Defense' and the 'State', and DEFINITELY NOT between the defence and the 'Court'.

Ratha's behavior has been getting out of hand.

🤣🤣🤣🤣🤣 Mshololo ended this whole argument with 1 question 👏👏👏👏 How was his statement commissioned in his Mngo was right that this statement was incorrectly commissioned. But Rata has admitted it saying he approves. How can he approve a non-compliant statement hence Mngo said he will not even go into it. Thanks Msho my girl.

The boss of the tavern is a hopeless example, he so bias and unethical. He should be removed in the interest of justice and making a mockery of the system. The JP must remove this guy before he makes unfair, uninformed judgement. We as the public is witnessing his partiality to state witness, Baloyi and suffocates council that the real truth is not exposed. Ganida and his gangsters, what a shameless display by a preceding officer.

to all those who believe that, this five young men before the court has committed an offence as alleged. My question is "why the state is struggling to place them at the scene and use the confession statements as they have been admitted" but they "state" is keep on bringing in the new evidence and ppl who can't even tell how senzo was murdered.😢😢😢 I personally don't believe that they were there when senzo was killed 🙋🏿

The double standard in this court! When Mngo read Sifiso Meyiwa's statement they said they couldn't see clearly who commissioned his statement and therefore, the validity of that statement was "not proven". But this Buthelezi officer his statement had some missing info that wasn't clear and they say if he attests that he wrote it is enough.

Johannesburg city has now changed to a guy named Johan. Instead of judge Ratha accepting that he was caught out, he gets emotional and bully. We all heard him. The statement/affidavit is not signed. How can this happen SA?

Judge why do you want to read this statement when Mngo said he is retracting the statement? What about Rob v Hepworth which says if the defense or State makes a mistake, the other must not take advantage of that.... So that only applies to the state and not the defense. Double-standard in this court.

As the Judge denied Mr Mngomezulu a chance to retract and apologize, it may be important to note that he himself said the following denigrating statements in the process. 1. "Mr Mngomezulu don't use words that you don't understand" -Normally, you have to first ask the person to explain what they mean before concluding that they don't understand. 2. "you accuse me of colluding with the state just because i asked the witness to read this 'USELESS' affidavit?" -This may easily be construed as an insult to the state which brought the affidavit to court as admissible evidence. In the end, Mr Mngomezulu retracted his words. The Judge didn't.
I must add that I love this judge. I genuinely think he is right almost all of the time in terms of the law. The only problem I see in him is that he applies the law in an asymmetric fashion i.e., he is quick to take the legal blueprint when he wants to make a point against the defense but hardly does the same when the state errs. He is right for example that the defense should wait for the state to finish its point before objecting. Common sense suggests that even in ordinary discussions, it is important to allow others a chance to speak before making your own points. But while this is the right thing to do, being raised by the Judge at this stage invites the obvious question of why the point had to start with the defense given how the state has constantly interrupted the defense. I am sure the judge will be the first to admit that he himself has hardly followed his own advice considering how he constantly interrupts Adv Mshololo. It is now well-known that Adv. Mshololo hardly finishes a sentence without an interruption from the court (the Judge to be precise). It is therefore against this background that Mr Mngomezulu's casual use of big and often inappropriate words such as colluding should be understood in its proper context. To be fair with him, it is often difficult, during the heat of the moment, to find the right and appropriate words to describe what seems to be an asymmetric application of the law.

Ratha is satisfied that the statement was properly commissioned while Constable Buthelezi who is the deponent was not present when it was commissioned. How did that John with no force number commissioned the statement in the absence of the deponent?

Sad is to side with a judge who has to be impartial. He just refused to play back the recording. That is quite telling of his ideas, thoughts, biases and of course his tavern decorum
