What is France's pretext for this presumably illegal action?

France is a republic. The president is the head of state/commander in chief and directly elected by "we the people". Their parliament is similar to Congress (like in the U.S. it's bicameral, the National Assembly and the Senate).

Article 19 of the French Constitution guarantees "[...] the right to freedom of opinion and expression WITHOUT INTERFERENCE and to seek, receive and impart information and ideas through ANY MEDIA and regardless of frontiers!" They also have a FOIA (freedom of information act).

Freedom of expression and access to information, online and offline, including—quote "political speech [...] and opinions that may shock, offend or disturb others" are also rights guaranteed by the EU to all EU citizens. However, the actions of the EU, e.g. the attempt to put pressure on Elon Musk, show what such laws are worth if the opinions expressed are not approved by those in power.

As far as France is concerned, I think it's also a message. They want people to understand that laws and a constitution cannot protect citizens when a government decides to ignore the laws and weaponizes the justice system against the people.

The Biden administration sent the same message when they rigged the election and sentenced those who complained about it to years in prison. What they are doing to Trump has the same purpose. Another example are student loans. Biden simply ignored the Supreme Court ruling on student loan "forgiveness". He broke the law by refusing to secure the border. Nobody wants an open border, but Biden didn't care. What could make our own powerlessness more clear?
