Form i130 Checklist for Spouses | Complete i130 Checklist for Spouses Step-by-Step Guide

The requirements for petitioning a foreign citizen spouse for permanent residence (green card) are more exhaustive than any other relationship. When filing Form I-130, Petition for Alien Relative, the petitioner must submit supporting documents to evidence the relationship, because immigration officials from the U.S. Department of State and U.S. Citizenship and Immigration Services (USCIS) have an additional layer of scrutiny for spousal relationships. After all, sham marriages are one of the most common ways to commit green card fraud. So immigration officials want to be sure that your spouse obtains a green card based on a genuine relationship.

Direct U.S. Immigration can help you determine which visa is the most appropriate for you.

I read below, that the petitioner needs to be working to use i-130. What if the petitioner no longer works (for whatever reason) because he is has enough money in the bank? Maybe he is retired, maybe he just has enough money not to work?

Hi, my husband filed for me in dec 2021 after we got married in Nigeria and refiled May 2023 after he was told the file got lost for I-130. He is a permanent resident and received a mail that we do not have any outstanding documents as our case was actively been reviewed. As at January 2024, my husband checked our status and saw “estimated time until case decision 1 week” then he checked after another week, the status was showing “your case may take more or less time” without the usual duration. Pls is there anything else we can do can? He has called and emailed but no response from them

My husband and I just got married outside the USA. I am filing for him but we are stuck on how to provide evidence of the marriage. I did not sign the lease for our apartment and I am no longer in his country because I had to come back to usa to work. I was not able to open a bank account there either while I was there because the banks were requesting so much stuff because I was a foreigner. We are stuck now. Any way you can help please

Hello: I want you to please clarify something for me. I live here in the US over five years now. I am a lawful permanent resident. In 2023 April I filed in for my wife along with my two step kids as riders. During that period of time I was 4 years and couple of months. Now I’m over 5 years and want to apply for my US citizenship but the attorney who did my wife paperwork is saying that I should wait until my family come to the US before doing my citizenship. Now my fear is that, I don’t know the actual year my wife gonna be approved for visa and My green card will be expiring in 2028 . The attorney further told me that if I apply for my citizenship, that means I will have to re-file for my wife . Meaning I will be starting the process all over again. I need your thought on this please. Thanks!
