When a police officer stops you, the first thing you need to do is make a judgment call on whether you're in a situation where if you behave a certain way, you may well get a break. Alternatively, if you don't think that's going to happen, you may need to go into immediate protect yourself mode. We have two different potential scenarios here: friendly cop and unfriendly cop. The friendly cop may let you off with a warning. The unfriendly one, well… that’s what this video is all about!

Notes from Pete:
1. Upon further reflection, if a cop commands somebody to shut off a video, the correct response is "I do not consent." If you want to tell him you have a constitutional right to record, fine. I don't think that adds anything. If you are on record saying "I do not consent" and the cop turns off the video I have a hard time imagining a prosecutor bringing charges arising from anything that happened after the camera was off.

2. It has never been decided that "I don't answer questions" is sufficient to invoke the 5th, but saying that you invoke the 5th leaves no doubt.

As a retired police officer, I am happy to say that your guest was on target with his advice! I appreciate how he made it clear that not all police officers are bad. It drives me insane that there are so many who are bad and I’m glad their illegal and/or immoral actions are being video recorded and exposed to the world. I just wish there were more hidden recording of good officers, who obey the laws and respect their badge/ authority, instead of abusing it!


I was never a traffics cop, but I did my best to catch drunk drivers before they killed innocent lives. The majority of drunk drivers survive their deadly crash, mainly due to how relaxed they are, vs. a sober driver/ passengers who automatically tense up as they try to brace for impact.

I never took things personally and recognize that we are all human and the person may have broken the law, but that doesn’t make him or her a terrible person. I often told those I arrested to zip it and get a lawyer and tried my best to help them understand what to expect throughout the entire process. I treated everyone I encountered with respect and did my best to help them, no matter what.

A friend of mine worked for a mortician over one summer. One of his jobs was picking up clients and transporting them from the hospital to the mortician to be prepared for the funeral.
"Do you know why I pulled you over?"
"Does it have anything to do with the dead body in the back?"
But he was driving what was clearly a hearse. It wasn't the nice one they used for the funerals, but it was clearly a hearse, with the funeral home information on the doors.

Back in the early 80's I got pulled over several times. This particular incident happened around 3:00 am in a small N.D. town, I was 💩 face drunk. The cop asked me where I was going & I told him home, which was 15 miles away. He asked me a few more questions that I recall. Then he asked me where I came from, I told him a friend's house. He says I want you to go back to your friends house and don't leave until I sober up. So I drove looking for my friend's house which I had a hard time finding, so I turned on my CB radio & told him I was having a hard time finding it. Lucky for me I found the the house shortly after that comment to him. He was following me to make sure I did what he said. I parked my Monte Carlo & safely stumbled to the front door.
I very much appreciate the officer not ticketing me for DUI taking me to jail.

This is exactly what cops do, started all friendly after stopping me for a supposed traffic violation, I answered i won't answer questions & once they realized i had a dashcam, called it off. even if there was an infraction he took several blocks to even stop me, and there was not actual traffic violation at all. 😅

"I don't answer questions" is incomplete. You need to communicate that you are invoking your right to remain silent.

Great information. If a cop is overly hostile, it can help to openly yet politely say "you seem very angry and hostile" just to get it on body cam.
