I always pound this home! DO NOT TALK TO THE POLICE! I will never be able to say it enough. I have seen so many cases where people agreed to be interviewed by investigators and ended up in handcuffs. This is the hard truth if the police can arrest you, they will arrest you regardless of whether you agree to give them a statement or not.
The police do not "clear" criminal defendants, that is not their job. I have represented many clients who believed that if they explained their side of the story to the police, they could avoid an arrest. Almost weekly, I get calls from clients who gave voluntary statements to the police, waived their right to counsel and ended up on the county jail.
On the other hand, I have never seen a case where it made a difference that a suspect refused to provide the police with a statement. If the police can arrest you, they will arrest you, that is their job.
I have seen many cases, like this one, were refusing to provide a statement and lawyering up actually resulted in no arrest being made. If you feel that you absolutely have to tell someone your side of the story, call me, I will listen to you. Better yet, call me as soon as the police arrive.
I understand, when something terrible happens, we feel the need to explain ourselves. Explaining yourself to the police, however, can have dire consequences.
The same holds true to for voluntary searches. Why do you think the police ask people if they will consent to search their car or whatever? I will tell you why, because the police do not have cause to search your car!
Be smart, try to remain calm, and most importantly, lawyer up anytime to police want to speak to you. I promise you, in the end, you will make out a lot better then if you agree to talk to them. A felony conviction can stick to you for a lifetime!
