I always pound this home! DO NOT TALK TO THE POLICE! I will never be able to say it enough. I have seen so many cases where people agreed to be interviewed by investigators and ended up in handcuffs. This is the hard truth if the police can arrest you, they will arrest you regardless of whether you agree to give them a statement or not.

The police do not "clear" criminal defendants, that is not their job. I have represented many clients who believed that if they explained their side of the story to the police, they could avoid an arrest. Almost weekly, I get calls from clients who gave voluntary statements to the police, waived their right to counsel and ended up on the county jail.

On the other hand, I have never seen a case where it made a difference that a suspect refused to provide the police with a statement. If the police can arrest you, they will arrest you, that is their job.

I have seen many cases, like this one, were refusing to provide a statement and lawyering up actually resulted in no arrest being made. If you feel that you absolutely have to tell someone your side of the story, call me, I will listen to you. Better yet, call me as soon as the police arrive.

I understand, when something terrible happens, we feel the need to explain ourselves. Explaining yourself to the police, however, can have dire consequences.

The same holds true to for voluntary searches. Why do you think the police ask people if they will consent to search their car or whatever? I will tell you why, because the police do not have cause to search your car!

Be smart, try to remain calm, and most importantly, lawyer up anytime to police want to speak to you. I promise you, in the end, you will make out a lot better then if you agree to talk to them. A felony conviction can stick to you for a lifetime!

Similar situation Cops come to my Wife and My house to arrest our son for some charge. I asked the two cops if one of them would read him his rights, the cops said they would when they put him in the car! We requested them to do it in front of us, his parents, which they finely did! As soon as they were done I told our son, don't talk to them, answer any questions and only sign for your release! He listened and when we went for his first court date, the prosecutor came to us before we went in front of the judge and said they were with drawing the charge because of insufficient evidence? Thank you those on u-tube who we learned it from!!

Years ago my first lawyer walked into an interview room at the jail. He introduced himself and handed me his card. Told me to memorize his phone number and memorize the statement on the back. It read:
- I would like to cooperate further, but on the advice of council, I cannot answer any questions at this time, without my lawyer present.
That very simple statement has saved me from wrongful prosecution and self incrimination, but the thing it saved me mostly was MONEY. I didn’t have to pay my lawyer to fix problems that my statements would have caused. Biggest part of a lawyers fee is discrediting the ‘evidence’, why would you give additional evidence against your self?

You can NOT talk yourself out of being arrested. You can only talk your way INTO being arrested.

I recently bought the book `You have the right to remain innocent` by James Duane. The stories of innocent people who went to prison because they talked to the police is mind blowing. Never ever talk to the police folks.

Patrick, I’m a retired Palm Beach County Prosecutor and Judge and my brother is a retired Miami Police Lieutenant, in the not too distant past, I always counseled those who asked, to cooperate with the police. Now, since I’ve read, “You Have the Right to Remain Innocent” and viewed videos by lawyers such as you, I would never speak to the police nor counsel one to do so without the presence of an attorney. I don’t know whether things were better in my day or I was just blind to it, but social media has sure opened my eyes.

Good advice. We have the right to remain silent at all times. Before, during, and after any dealings with the police. Silence is golden.

Never talk to anyone from the government without consulting an attorney. If a communication to the government is needed, allow the lawyer to communicate ( or not communicate) on your behalf. Once you invoke your right to an Attorney, nobody can speak to you.

Thanks, for this great advice. I have zero problem with bad people being locked up however, Police/Prosecutors only look to close cases whether you're actually guilty or not. Thank you again sir.
