If an item is damaged or you dropped it while paying, you can get a new one, especially if you're shopping at a super market. But if you bought the item and left the store and then you noticed the damaged, then you'll gonna have some difficulties...

In my experience they will give you a new item, if you ask them nicely. But I live in Berlin, so I dont know if this is a Berlin only thing in germany.

A Florida Karen would have SLAMMED the bottle on the counter while making eye contact to get another one, while sticking up her middle finger. She may call you every name but a child of God.

Actually if you get a „Schlechtleistung“ you can sue the retailer for „Schadensersatzanspruch“. So in this case you could argue that the Water bottle had significant damage before the sale. And since the German Zivilrecht supposes wrongdoing if no evidence exist you could get Schadensersatz. I’m German and I have successfully done this in the past. Of cause you still lose money but it’s about principle.

Which translates to:
Every merchant is obligated by law (§§ 437, 438 BGB) to provide a two-year warranty (also known as guarantee of freedom from defects) on new goods and a twelve-month warranty on used goods. The warranty covers any defects that the product may have had at the time of purchase.

I was living and working there for many years they are serious about recycling ♻️ you will get a big fine if you didn't. And to see a damaged product out for sale its very rare 👍🏾😄 . I've lived in Schweifurt Kitzingen Würzburg and Stuttgart.

True I even had a customer service agent hang up on me when I tried to explain that they had sent me the wrong bill! When I called back and asked to speak to amanager the new agent seemed not to know what to do...BUt fortunately solved the problem! unbelievable in the USA

Actually Germany has very strict consumer protection laws, but you won't get refunds for going full Karen here😂
