Hot take:

Nintendo has been the most hostile company in gaming for the last several years (Eclipsing both of their competitors which ... is amazing in itself). This has included the way they treat content creators (Constant violations of fair use), the way they threaten and treat their end users who want to setup group play sessions (Smash Bros competitions or parties.) The attacks on the open source community through dubious lawfair and bullying to get projects they don't like halted.

At this point Nintendo needs to feel the repercussions of treating everyone as the enemy. Giving them money by purchasing software or hardware only reinforces their god awful behavior. For me Nintendo has jumped the shark and they will never get another penny from me. Others may not care, but seeing how abusive Nintendo has become should give anyone pause at this point when considering supporting them in any way.

I buy all my games physically and dump them so I know they're preserved, and I'm able to play where I want. Going forwards, if I ever buy another Switch game, it'll be second hand. None of my money will go directly to Nintendo, as they are currently a threat to games preservation and development (PalWorld patent suit).

I am not a lawyer, but I believe the DMCA has exceptions for making personal backup copies of copyrighted media, which is how people ripping their own cd's and dvd's for personal playback is legal, and how you can legally use mp3 players and the like.

What can we do about it? Big corporations will play their game. I haven’t pirated anything in decades, but now it’s an exception. I’m playing the new Zelda on Yuzu without any guilt. And, I have over 100 purchased games for the Switch. So, they are just unnecessarily provoking anger in us who use emulators because it’s a better experience to play on them. As far as I’m concerned, until the situation improves in their relationship with the community, Nintendo doesn’t exist for me.

Stealing is indeed wrong. Abusing the copyright law is wrong. Keeping 160k customers in the dark about the data breach is wrong. Asking 60 dollars for a 10 year old game is wrong. Ignoring Joy-Con drift is wrong. Bad refund policy is wrong. Using child labor is wrong. And many many many other things are wrong.

However, it seems that only the small folk are being held responsible for being wrong and big companies like Nintendo just keep maximizing their profits while not changing one bit. On the contrary - by being shittier than ever.

Two wrongs don't make a right but people who pirate their games should sleep like babies.

Since I got my SteamDeck, I've used my Switch 0 times. I'm not even emulating the games I have on it. I just bought the PC versions and moved on.

Consumers can go scorched earth too! Don’t buy Nintendo consoles or games. Don’t pirate their games. Don’t even mention them. The feed off attention and money. Starve them for long enough and they’ll come around. Consumers have the power in numbers, we just have to collectively learn how to properly wield the power we have to train Nintendo on how to properly treat their customers and fans. If not, then we’re just complicit in their unkind and unjust antics.

You know there's one other way to combat piracy and that's open up your games to all hardware. The monopoly of propriety cartridges and hardware won't last forever. People love your games not the goofy hardware they run on.
