What is Wrong With The New Criminal Laws? Explained ft. Indira Jaising | IPC vs BNS

In this video on The Wire's Zeeshan Kaskar delves into the significant changes coming to India's criminal justice system starting July 2024. The Indian Penal Code (IPC) and Criminal Procedure Code (CrPC) will be replaced by the Bharatiya Nyay Sanhita (BNS) and the Bharatiya Nagarik Suraksha Sanhita (BNSS), marking the first major overhaul since the 19th century.

The cases registered before and after 1st July will fall under two different sets of laws, potentially causing confusion and delays in the judicial process. Despite claims of decolonizing the justice system, he highlights that 95% of the new BNSS is essentially a rehashed version of the CrPC.

With insights from renowned lawyer Indira Jaising, Zeeshan breaks down the issue into six key points: the arbitrary nature of passing the law, the reintroduction of the sedition law, the non-mandatory status of FIR registration, the delays in justice amidst old versus new laws, concerns about arbitrary detention and police power abuse, and the myths surrounding digitization and technology.

Police still take bribes in order to file an FIR in our areas. They will write your complaint but unless and until you fill their pockets, they are not going to write an FIR for you. This still happens.

Why not implementing Police reform which is pending since 2006?

The new 'Bharatiya' laws are not only idiotic, but also pernicious!!
I've been saying this ever since these 'laws' were 'passed'...!
Just like Agnipath/Agniveer scheme was the most idiotic & pernicious thing to occur to the Indian military & national security, so are these laws for Indian legal system, judiciary, and individual rights & freedoms...!!
Yet another classic example of BJP's ineptness of framing laws/policy...Beyond a certain point, ineptness can't be distinguished from malice...and I am beyond being charitable now, and I genuinely think this was done deliberately by BJP in order to make India a more police state...in order to retain power, and try to rule in perpetuity...

Thank you so much for enlightening us. God be with us to protect us as justice could be further delayed than it is now.

1. Criminals are making this law.
2. Bill was passed without any proper discussion.
3.It was passed during the suspension of MP's which is not valid...

Request The Wire to add citations to all their videos. I am searching for the part that says that for offences carrying a sentence between 3-7 years filing the FIR will be at the SHO's discretion.

Thanks Kaskar for an insightful video. These apprehensions are solvable if the opposition focuses on issues and not power. For eg opposition can demand a constitutional amplification or legal interpretation of sovereignty, integrity, and unity. Thanks

When uneducated leaders are ruling the country and changing the laws, we educated guys shouldn't be concerned about digitization and implications.... Why don't we use our brains to become more creative ?
