The police are starting to use drones (even drones made from taxidermied birds!) in their investigations. How is this legal!? To answer simply, it's because the U.S. Supreme Court hasn't kept up with rapidly changing technology, so police are currently able to get away with pushing the boundaries set by the fourth amendment.

For example, existing case law has ruled police can use helicopters to conduct their investigations, so that is the closest law that actually sets boundaries about aircraft recording backyards. How do you feel about police filming your private backyard with drones?

I know the absolute best way to get courts to change the rules.
The day of the trial, live stream video from the judge's house (or for courts with multiple judges, like SCOTUS, **all** of their houses). Because the rule has always been that the cops don't need a warrant for something ANYONE can do. If they don't need a warrant to send a drone in, a civilian doesn't need permission to do it either.

Of course they are. I was walking around one day, got the feeling someone was watching me, I looked around and bam drone. It noticed me watching it, and it flew away... I was close to the police department and guess where I spotted it going.. 🤨

There is a rule that limits that

FAA has a law for flying drones.

People try to use drones to spy on celebrities and the FAA has declared that less than 1200 ft AGL is private airspace or private property.

Air is considered above 1, 200 ft.

Leas than 1200 ft is invasion of private🎉 property.

Ask any pilot.

If the back yard is fenced in, then it is by definition curtilage. Thus any images or video and any evidence from the poison tree are inadmissable in court and subject to lawsuit for 4A violation.

Did anyone catch that last part about fixed "wing" aircraft. Drones have no wings. Nor do helicopters.

If they do not need a warrant to fly a drone above your residence, then it is ilegal to take down a drone flying over your hause?

If you’re over my property you’re trespassing and that drone is going to get shot down 100% of the time. And the dogs REALLY want you to come into the yard and get it!

Did you know that raptors are often trained to remove such things from their sky? It's quite easy and extremely effective. There are more raptors than drones

If they do not have a 107 certificate, its a violation of federal law to use the UAS for commercial purposes. Surveillance is not a recreational flight, so your PD using it can be tracked by an app. And file a complaint with the FAA. 1500$ fine per violation. Lets say you wait an document 100 flights. 😂. Yes the FAA will cite then 100 times, and possibly refer to the DOJ.
