In this video, FOR SA's Legal Advisor, Liesl Pretorius, discusses the wide definition of "harm" in the Prevention and Combating of Hate Crimes and Hate Speech Bill. Harm is one of the elements for an expression to be deemed to be “hate speech” by the Bill. The Bill proposes criminalising expression it sees as "hate speech", suggesting jail sentence of up to eight (8) years.
TAKE ACTION:
- The Bill is currently open for public comment until 13h00, Friday 12 May 2023.
WAY FORWARD:
The Bill was passed by Parliament’s first house, the National Assembly, on 14 March 2023 and sent to Parliament’s second house, the National Council of Provinces (“NCOP”) for concurrence. The NCOP’s Select Committee on Security and Justice will start working on the Bill on Wednesday, 19 April 2023. If the NCOP passes the Bill, without amendments, it will be submitted to the President to be signed into law.
