Surely pulling over a drunk driver before he has injured anyone would constitute "preventative" law enforcement, and therefore a rights violation.

The problem is, the decision of the court on what is safe enough effectively becomes regulation. The court has to decide which experts to listen to, and that decision effectively becomes regulation. The court has to decide what you have to do to demonstrate safety, and that effectivey becomes regulation.

If they driving dangerously on a shared obligation road, regardless if it is because of alcohol or other, then they are a threat to others. The violation is that they knowingly chose to put others in danger. Then let justice prevail.

How so? Regulation is the presumption of guilt which is immoral. Each case is different, it does not become the law of the land, it is just one evaluation on a given set of criteria. If those criteria change, then so does the case. It will result in dispute resolution which is a good thing versus universal avoidance on false premises.

This is the regulation I live under in the Canadian nuclear industry.
Notice it's only about 100 pages .

Also, the Canadian regulator makes a lot of use of the CSA, the Canadian
Standards Association, a private for-profit group. Instead of re-doing such things
as how to write software, they simply reference CSA N286.7.

I absolutely need a clear definition of "safe" before I start building. And I need to know that if I follow that definition that nobody can sue me. Also that no legislator can injunct me. I need to know before I commit $10 billion for a decade that the plant will be permitted to be finished. This is why the anti-nukes hate nuke regulation. It gives tthat clear definition.

Building a nuke plant takes 10 to 15 years. If I have to stop and fight a law suit every 10 minutes then I can't possibly do it. Law suits often take years. A one year delay in a $10 billion construction costs about $1 billion. So the court has the same power as regulation. And it can change every time a judge gets a wild "expert" up on his witness stand. Viz. Diablo Canyon.

My take is that the speaker was referring to a society of objective law, not what exists today. However, if it was objectivism the predominant philosophy we would be talking Fusion reactors or better.

but Health Insurance should not be used for basic health services but it is used because some doctor's charge too much for an office visit my last GP charged 200 dollars for a 15 minute session, really.but its this stuff that has caused problems for rising healthcare cost. And No, I'm against the ACA ( obamacare ).
