What Is 'Moonlighting' & Is It Lawful In India?

Moonlighting essentially refers to the practice of holding more than one job outside the normal working hours without the knowledge of the principal employer. An employee may work a normal 9-5 job as a primary source of income but work nights at a different job to earn extra money. This is generally done to have another source of income or even to make better utilisation of one’s talent and passion.
However, the problem arises when you are working under two formal legal contracts and working for your rival company as well.

According to me, if a person wants to do dual job without leak the data of the particular company and work sincerely, which increase his knowledge and work experience for his better future, then moonlighting is good.

Ma'am this is the time where we need jobs because if you are aware of current situation many lost job. And now a days whoever working in private sector didn't get much amount money to survive in decent ways. It is okay to say people might disclose confidential data to other company but if there another way out is that if alternatives work would not done in similar type in which he is working then it will be okay.

Would freelancing of the same work you do for your respective organisation be considered moonlighting even when there is no agreement between the freelancing clients and the person doing the work, for example freelancing at upwork?

Mam, what if person A is founder and CEO of early stage IT startup but startup not earning any money yet and same person A is doing job at MNC as well then will it be catch by MNC, as there is no PF account and no TDS deduction there because startup is early stage?

Contractual employees can do moonlighting, not otherwise prohibited. But prohibition is against the right of freedom of work or profession.
