I am not a lawyer, but that was such a weak sauce reason in part of Disney! Because of arbitration? REALLY! Before this case expands further they simply need to pay and settle or is going to get worse when it comes to their reputation.

The ToS argument is absolutely first level legal shit that protects the entire company from lawsuits. "Oh, you were killed by peanuts? Do you remember clicking a box on a screen 4 years ago?"
I dunno, its a big company with many moving parts, one chick dying because a restaurant that is doing 100 covers in an afternoon sounds like nature giving her the middle finger.
