When you’re riding a bike and you are in the bicycle lane but you still got hit by a car in a way that is not your fault, first things first, if you’re able, call 911. Report it to the police the quickest way possible. If not, look for witnesses and ask for help. You need to get somebody to protect you. Sometimes, there can be a hit-and-run situation in bike crashes. Get the information of the other driver. If they’re a good person, they will pull over. If you can, take pictures of the other driver’s plate, driver’s license, take pictures of any damage and your surroundings.

So, take care of yourself first then, get paid for your pain and suffering. The other driver’s insurance company will pay for your pain and suffering, depending on whether it’s a no-fault state or fault state. Your own insurance company will also be involved. If there’s not enough to recover from the other driver’s insurance, you may also be able to sue your own insurance company. You may have underinsured motorist coverage in your insurance which applies to bike cases in a lot of states.
