As a Patent Agent from India, I can only say, if US startups file their first patent in India, they can save thousands of dollars. Cost of patent services in India is much lower than the US, and the Indian government gives an 80% discount on patent filings for startups. Also, you can get a professionally drafted application drafted and files for less than 1000 dollars. Also, PCT filings from India also cost less. So, if you are a US startup, make a subsidiary in India (Good cities: Gurugram, Bangalore, Hyderabad, Pune) and file all your applications from India. This will save you millions of dollars in building your patent portfolio. Also, engineer salaries in India are much lower in India.

By the way, many US law firms anyway outsource a lot of the work to India, so we have a large workforce that can draft patent applications for US and EP jurisdictions. Also, most of the patent searching is done in India.

I.e., Build your R&D in India and first file in India and then take it to the world.

In general, you don't file a patent to sue competition. You file a patent so competition doesn't file a patent and then sue you.

I agree with Elon Musk about patents. They suppress innovation. The best way to protect your IP is to innovate faster than the competition, that's what Tesla does. If software, Hardware or any solution is superior to the competition, you will win.

Thanks for this video. I was in the process of looking for an IP lawyer to try to patent my idea, but I think it will be a waste of money at this point since the idea most likely is not patentable anyway.

Google made a mistake when it patented the1-click Buys. They should have patented 2-click, 3-click, 4-click, ... 17-click buys as well. Leaving royalty-free only the 18-click buys and above, crippling the entire e-commerce industry before it was even really matured. All patents are bs.

You might actually want to file for patent to make sure that you are not infringing on other's patent. Then you can get in the real trouble.
