What’s insane is this ability to violate someone’s right to own firearms without due process doesn’t increase the safety of a spouse that is actually dealing with domestic abuse. If someone is willing to use a gun to kill, pretty sure they don’t care about the law saying they can’t own one.
And no, a restraining order is no due process as it’s easy to get one by lying 🤷‍♂️

As a former prosecutor in Alaska, who also believes in reasonable interpretation of the 2nd Amendment, after several bad decisions, this Court finally got one right. In 99 percent of the domestic violence assault cases keeping guns out of the hands of abusers, protects women. This ruling also seems to safeguard laws in states like California which make it a felony for anyone convicted of a firearm related felony anywhere, to possess guns or ammunition inside California. This law was passed in California in 2019, and many don't know it exists.

Advocates for victims of domestic violence have closely watched the case, hoping the high court would preserve protections that bar people accused of domestic violence from possessing guns. They estimate that the risk of homicide in domestic violence incidents increases by as much as 500% with the presence of a gun.

The guy who owns a firearms company is makimg such a bad faith argument. How many people does he imagine are falsely convicted of domestic abuse cases, and how does that stack up against the number of people shot in domestic abuse cases? The victims have rights as well.

Even though I agree with the overall decision, I do also agree with Clarence Thomas’s opinion that this can be a “slippery slope” as basically one judge, without a criminal conviction for domestic violence, can take away your 2nd amendment right to own a firearm. In other words, a judge can issue an order that bans someone from owning a firearm without that person having the right to defend themselves in the court of law.

So if your partner lies and gets a protective order against you, or accuses you of domestic violence, one judge can take away one of your rights for life. Not a jury, but a judge. So I do see the concern there. But overall I agree that domestic violence individuals should not own guns, I just think there should be safeguards in place for the wrongfully accused.

This does not remove the ability of anyone to own a gun. A drive down any side street on the bad side of town can get you a $300 hand gun for only $600, no questions asked.
