Why You Should Never Threaten a Lemon Law Claim or an Attorney if You Have a 'Lemon' Vehicle

If you bought a new “Lemon” vehicle and are experiencing too many defect problems you might be wondering, “Should I Threaten to bring a Lemon Law Claim or to Hire an Attorney in order to get my vehicle Reacquired or to be Compensated?”

The short answer is, No! You should never, ever threaten to bring an Arizona Lemon Law claim or that you're hiring a Lemon Law attorney.

Here’s why. After dealing with numerous or repeated repair problems, most people reach a tipping point of being fed-up. If the dealer or manufacturer is unwilling to assist with getting you out of your Lemon vehicle, your first instinct may be to threaten to pursue a Lemon Law case or to hire an attorney. There are several reasons why you should NEVER do that:

1) Being a likeable claimant is important in Lemon law claims and being rude or making threats will actually hurt your ability to get you out of this problem.

2) Even if your vehicle has been in the repair shop a long time and/or numerous times, you will need a complete repair history and all of your vehicle repair records to pursue a Lemon Law claim. If you threaten an attorney or a Lemon Law claim, the dealer will go into defense-mode and could alter the records and minimize the repair issues or fail to document some of the problems.

3) Some typical ways they do this include: claiming that repairs were done for “goodwill” or not covered under warranty; claiming that the issues complained about “could not be duplicated”, there was “no problem found”, or the vehicle was “operating as designed”; or admitting there is an issue, but blaming you for it. All this greatly complicates proving a Lemon Law case as a he-said/she-said situation is much more challenging to prove compared to having repair records where the vehicle issues are well documented and admitted. Repair records are the number-one piece of evidence in Lemon Law cases and you don’t want the records tampered with before they are given to you.

4) Similarly, if you make threats to the actual manufacturer, they could flag your vehicle in their internal system, which may result in the same shenanigans with repair records or difficulty obtaining repairs.

The best course of action is to bite your tongue no matter how aggravated or upset you are with the situation and make sure you have complete records of everything that was done to diagnose and repair your vehicle under warranty.

Then you will have the ammunition you need to pursue a Lemon Law claim for a Refund or Repurchase, or a breach of warranty claim for Cash Compensation.

Never threaten, find good legal advice and file the lawsuit - never let the dealer, manufacture, repair-shop know what is going to happen, let your lawyer and the courts do that for you!

Good informative video. I have a quick real life story for your "Lemon Law". I took a friend to a well known (Illinois) dealership to finalize his purchase of a used vehicle. He called ahead and when we got there, they had the vehicle in their repair bay. They said they were doing a final check on the vehicle. Papers were signed, They pulled the car out of the repair bay, parking it, engine off, at the side door where we were waiting. My friend got in, started the car, and I got in mine. He moved the car about 12 feet to the exit where the car engine quit. My friend attempted to start the engine but it failed to catch. The dealership claimed it was his fault, that he HAD to have done something. At first the dealership wouldn't do anything saying it wasn't their problem. That's when I threatened the Lemon Law! That the car hadn't even gotten off their lot! That seemed to light a fire under their - butts. They got very nice and pretty much kissed both of our butts after that. So, in this case, threatening the Lemon Law did help - outside of Arizona at least.

I have a 04 and 14 and i can not pay enough to get mechanics to fix my cars right and keep them running I went and bought my own tools and a scanner now I can track down my own mechanical problems and I have saved a lot of money doing it and most things are simple

People who threaten to hire an attorney usually do not. If it hit the requirements just hire one and keep your documentation.

I had a 2013 Altima V6 with technology package that had a slightly slipping auto transmission. Car purchased in early September 2013. Nissan bought it back full price under California lemon law in June 2014.

Yes you’re right. I just dropped off my car to dealer on Monday. They was found my 2020 Honda odyssey have a Malfunction VSA code and written down on the paperwork and verbally told to talk to honda because the transmission needed to replace But Honda have parts shortage issues and the transmission was made by European company. I should need to wait for months. Due to this was a 4th times to visit the honda dealer in past two years. At the same day, my lemon Law attorney told me to ask for buy back due to the issue. And I did. But on the next day American Honda’s technicians refused the dealership’s technical request and they said the dealerships must been duplicate and recorded the issue before repair. Today, the dealership’s service manager told me that due to their technicians unable to duplicate the issue, I could pickup my car or leave the vehicle for them because they will let the technician to drive my car home 150 miles a day and everyday with a computer connected to my odyssey until the issue is able to duplicate. If you don’t want to wait please call American Honda and ask for a goodwill.
Due to my car already over 37000miles the dealership and American Honda refuse to give me a rental car. I need to pay for it.
The dealer stepped back and told me different story. And they told me the malfunction was wrong.
I asked for buy back too early. I feel sad because too late to see your video.

FL law is 3 repairs within 24 months. I'm going in for my 6th time today l within 24 months for a suspension issue that's not resolved for a 2021 Toyota camry that I leased in June 2021. I don't know what else to do other than get another car due to the defects. Update finished arbitration and they're buying my car

Neither can do anything about it, do or do not tell them. It will make know difference in the end, if you do in fact intend to pursue a lemon with an atty.

If you want something done and done right you better do it yourself because mechanics will keep you coming back over and over again at a price on YouTube they show you how to fix every thing. I found out how to put a timer on a washing machine and then bought one and put it on cost 75 dollars for a timer or 700 dollars for a new washing machine

You don’t always need a lawyer to get the manufacturer to buy back your lemon Mercedes Benz bought back my 2021 gle amg53 after the 3rd visit at the dealership for the same issue they approved the buy back in less than a week after I called

What about arbitration? With my manufacture it states that to do arbitration first but I contacted a few attorneys, one told me I do not have enough at this point but to keep bringing the car in, then another attorney stated I have enough for them to file a claim. I am not sure what to do at this point.
