Ok here's my question. He mentioned that he would recommend not getting a trademark in the beginning to test out the market and get sales. If I choose this option, should I change my store name & display name to the brand I'd like to use in the future? or continue using my generic store name on AMZ that I currently have.

The problem with that in my opinion is somebody can take that name and trademark it before I do. Maybe I'm just overthinking. any help would be appreciated.

Hi Lenny! In most JS videos about looking for products, there isn't much emphasis on the rank number. Other Amazon gurus DO emphasize this, and I'm not sure why. Could you comment on how rank plays into the "sweet spot" product research equation?

Hi, I have found a product that I wish to sell but whilst researching I found someone else already selling the exact same product. They have a seller name but I cannot see any trade mark and they do not have their label on the product etc. Can I sell the same product on Amazon without getting the listing removed or getting in trouble? What is the best way to check if a company is trademarked on Amazon? Are the rules the same for private label and trademark? Thanks.

In regards to the first question you say “no, you don’t need trademark” which is great but you don’t talk about having to get an exemption approved to sell your private label product... why is this never discussed?

Need some direction here.
When using the JS rank calculator, it gives me a different estimate on amount sold (30 day average)
When comparing it on the JS product tracker.
This item is ranking in Kitchen / dining
the rank is 10658
and in the calculator I'm getting 233 units
and in the tracker I'm getting 16 each day ( 480 for a 30 day period)
Which one do I follow

so if i want to sell a generic product from alibaba to amazon...and i dont have a brand...lets say i call it abc...where do i register? do i need to register? or do i just go ahead and write in the amazon description abc products etc? I'm confused i dont want to trademark it..i just want my own name and logo until i know its selling

Lennard, when you say "no you do not need a trademark to sell on Amazon" - what is the alternative to not having a trademark and being in the Amazon brand registry? In my understanding, you need one of two things to list a product on Amazon (private label or otherwise). 1) a valid UPC registered to the correct business name and verifiable at the GS1 website or 2) you are part of the Amazon brand registry (which means you don't need UPCs to list your products; you can list them all under your trademarked brand). But to be a part of brand registry you need a registered trademark (not just the serial number they give you when you apply). So, Lennard - what is your solution if you are not part of Amazon brand registry? Buy individual UPCs for each product you launch?

Here is the exact email I had with a member of the brand registry team at Amazon:

My question: Can I use brand registry with my serial number that we receive once we file the application? Or do I need more than that? I am hearing that I could be waiting for 6 to 12 months on the government to register my mark.

Here is what my lawyer told me:
The serial number is provided once the mark is filed.
The registration number and the certificate is received once the mark is registered.

So can I use the serial number for brand registry? Once the mark is filed? Or do we need to wait until the registration number and the certificate is received once the mark is registered?

Answer from Amazon: Please know that serial number and registration number are different. Once you submit the application in Trademark, they will give serial number. Once the brand is completely registered under Trademark, you will get registration number.
