I’m pretty sure there IS a law that requires planes that have had people onboard during a tarmac delay to be moved to a position where passengers may safely disembark before 3 hours elapse (4 hours for international), regardless of whether they are on an arriving or departing flight, as long as doing so can be done safely and securely and air traffic control can handle things adequately to allow it.
In addition, a snack and water are required to be provided before the delay reaches 2 hours. Adequate toilets, comfortable cabin temperature, and, if needed, adequate medical attention, are all required at all times during a tarmac delay
Following the incident, the passengers may report what happened in a consumer complaint to the US Department of Transportation.
