Dewayne thank for sharing this informative video. I have your book and have been studying it. Both of these have prepared me for preparing my claims. Your book is concise and to the point. Thank you Brother.

Hello David and Dewayne, thank you both for the great information that you are providing for us all, my first question is for you David, what is the veterans best way to get his house repaired without having to pay out of his pocket if the appraisal was not done very well and I wasn't aware that very few of the repairs were done and we have been in the house for less than 60 days now, please tell me what can I do next to get my new home repaired without going into my own bank account?

does that 1 year presumptive after getting off active duty nugget (no need for Nexus, only need Diagnosis) 1. apply to joint conditions? 2. apply to reservists that get off active duty?

1. Can we file a new secondary for the same disability as a primary claim's, simultaneously?

2. Can we use a protected EEO/MEO complaint (email, paperwork, letters, MFRs, etc.) to prove that racial/sexual/religious discrimination caused a post-service diagnosed anxiety disorder? Or is EEO/MEO/legal stuff protected from C&P and others as inadmissible? If it's wiser, maybe don't need to upload, and just simply speak about it during a C&P?

3. Is uploading a PUB or other government URL that shows studies saying that so and so disability is indeed linked to the other existing one, is that enough evidence for secondary?

Help please worried I can be reduced.
Be careful at VA urgent care visits. I went to urgent care to request lidocaine patch for back and cervical pain recent flare ups. Doctor wanted to do a range of motion on lumbar and cervical i said no it hurts to bad. He asked if i can move my legs i said yes but hurts my back to do leg lifts. A few days later i read doctor's notes and he wrote that i deferred cervical and lumbar spine examination and that "patients was able to extend lower extremities fully on extension and flexion" he also wrote no weakness lower extremities which is not true.
He didn't even do a flexion range of motion test on my lower extremities 😡 i told him both my feet were numb tingling From sciatica. Some VA doctors just make shit up to put in their notes. He did say i had degenerative disk disease and advised i do a consultation with an orthopedic doctor.
Can i dispute what the va urgent care doctor said about my lower extremities because i have painful motion doing leg lifts ?

Hi Dewayne, I heard in the video you said the VA can only infer to grant, not deny. Last year I filed a claim for three disabilities. In my decision letter, I was granted all three. Then It went on to say Entitlement for individual unemployability is deffered. I had not applied for TDIU. Does this mean it was infered? I went ahead and applied for TDIU and was ultimately denied. I still have time, should I file a higher level review?

I in 1993 retired from the Navy, my prescriptions are free. I have a DOD Pharmacy 2 miles from my house. My prescriptions are mailed to me, having to pay a copayment is a burden. Last year I had to pay over $700 last year. The VA will send the prescriptions to the DOD pharmacy.

What qualifies as a diagnosis? My med records (military, VA, and civilian) only talk about knee pain and swelling...no cause was ever given...is that considered a diagnosis?

I’ll tell you this is a coincidence I just received my letter saying that the VA received my claim and it says can my own doctor perform a VA claims exam and it says “no” on the paperwork directly from the VA. In M21-1, Part V, Subpart III, chapter 1, Section A it says I can.
