Under Texas Property Law, restrictive covenants (also known as "Deed Restrictions") are covenants that affect the use of certain real estate.
Restrictive covenants can limit enjoyment of land by prohibiting certain use or activities or by mandating use or payment of assessments and fees.
The Texas Real Estate Attorneys at R L WILSON LAW FIRM | San Antonio Real Estate Lawyers have a deep understanding of restrictive covenants.
We have extensively litigated the validity, enforceability and interpretation of deed restrictions in numerous Texas counties.
Our firm's foundational philosophy is that Texas landowners inherently enjoy the right to use their land in the manner they see fit, so long as such use does not:
(a) violate a valid law, ordinance or governmental regulation;
(b)Unreasonably harm or pose a risk of harm to a neighboring landowner or that neighbor's reasonable use and enjoyment of their property; or
(c) violate a valid restrictive covenant.
We defend the rights of landowners from unreasonable regulation that violates our sensibilities, and help to enforce the rights of landowners suffering as the result of another's use of land. Call us to learn more 210-223-4100
