Judge denies defense attorney's motion to postpone trial, interrupted repeatedly by boss

PROVO, Utah (KUTV) — Supervisors of Benjamin Aldana, Kent Cody Barlow's attorney, were called to court to find out if they can provide Barlow with the legal counsel he is entitled to have.

Aldana requested to delay Barlow's trial due to his own father's health. Supervisors from the Utah County Public Defenders Association attended a court hearing Tuesday.

The hearing, filled with interruptions by Aldana's boss, tested Judge Robert Lund and showed an inherent problem with staffing levels at the Utah County Public Defenders' Association specifically for this case.

I know an excellent PD who had 50 open felony cases on her desk and was expected to provide effective, competent counsel for each one. Motions, witness statements, reviewing video evidence, jail visits to the accused, case preparation, incompetent supervisors made the job of providing effective counsel nearly impossible.

It's a job that features high stress and relatively low pay. Burnout is common for dedicated PDs.

Going to be a pretty easy win on appeal when counsel admits in open court before the trail they know nothing about the case and will in fact be ineffective

Not her fault for being assigned a case without proper time to review it. Somebody has to show up to represent the client. The judge is going to have to grant an extension.

This is a joke. Delay tactic. There are rules of criminal procedure that set deadlines. Her being unprepared is her fault not the court's

I’m glad he’s taking this case seriously. I had the unpleasure of dealing with judge Lund for three years and Lisa was the defense attorney for my ex and she stays never ever ever being prepared. I’ve not once witnessed her come with preparation and it amazes me they actually both have jobs still.

Public defender offices get the least amount of funding compared to prosecutors offices. Which also means personnel limits. But that like the judge says is a double murder case. All hands on that case! She’s correct she will be ineffective!!

This judge apparently doesn't understand how overworked public defenders are. Pray you never need one. Underpaid and overworked.
