Ans-1
Unlawful Activities Prevention Act, 1967 is a measure to curb the unlawful and terrorist activities. This Act provides the government and police powers to detain unlawful group or individuals. Despite being India’s primary legal weapon against unlawful activities this Act is criticised at various levels by many scholars.
This Act is often considered to be in violation of Fundamental Rights as:
1. Against Democratic Principles: this Act is against the principles of democracy as often innocent people are arrested just for protesting as misuse of this power.
2. Vague Definition: The Term terrorist activities is not clearly defined in the Act making room for error and deliberate wrong arrest.
3. Misuse of Power: on several instances police and other official have misused this power and had arrested students, protestors, opposition leader for protesting. This is clearly violation to right to freedom under Article 19 of the Constitution that permits to protest and express opinions.
4. Stringent Punishments: The Act provides stringent and very harsh rules making it impossible to be saved from it even for the innocent people.
5. Supreme Court’s say: SC also in Hitendra Vishnu Thakur Case has said that by misusing the vague terms, protestors can’t be arrested just to suppress the ongoing protest.
This Act is a growing threat to the democracy of India and is often misused. To prevent misuse of powers, the Act should be looked into and should be given a clear definition and certain strict guidelines.
