What is comparative negligence?
Comparative negligence means that the negligence of one party is compared to that of the other party in order to properly determine the amount of compensation that the injured party is entitled to. Florida is what is called a pure comparative negligence state which means that a person that is injured in an accident can still recover, even if they were mostly at fault. The amount they would recover however, would be reduced by the percentage in which they were determined to be at-fault. So if they were 60% at fault for the accident, they would only recover 40% of the damages from the other party.
