It is possible that house elves were free in America! Some of the house elves in this movie could be seen wearing regular clothing and being openly disrespectful and rude towards humans without being afraid of repercussions for their actions. On the other hand, the house elves in the Harry Potter movies' British wizarding world were held in servitude until their owners gave them proper clothing, and were forbidden to own wands, although they could perform magic without them.

I'm pretty sure those are pukwudgie's. A pukwudgie is a magical creature native to North America noted for their large ears and striking resemblance to European Goblins. This explains their clothes, greediness(see the bartender, I think he was the bartender) and more sturdy build. It is also to be noted that between house elf's and pukwudgie's, house elf's tend to have more flat skulls and less defined chins.

They may have some more opportunities in America but places like that Wizard Gnarkak’s speakeasy seems more like an underground tavern that operates outside the law. In places like MACUSA congress buikding they seem to have low jobs such as shining wizard wands or work as employees like elevator operators

So at very least they may have enough rights to have low paying jobs instead of enslavement, but may have less pay than Wizards and had to work in more menial labor, turning to speakeasies like Gnarkak’s tavern to get better jobs
