The Supreme Court and at least six high courts have termed the two-finger test ‘unconstitutional’, ‘unscientific’ and being ‘violative of a survivor’s dignity’. Despite that the police and medical examiners insist on performing the test to determine whether the survivor is “habituated to sex” or not. Such a test or result is inconsequential in cases of sexual violence.
