Falling Down

The plaintiffs say the defendant built them a pool and retaining wall that collapsed into their yard and damaged it. They say the defendant refuses to cover the costs, so they’re suing him. The defendant says the did the work years prior and still agreed to fix the wall, which he did. He claims they’re just being greedy.

Defendant sounds like an honest guy: He willingly admitted he saw a $250 dumpster on site during his repairs. The judge will take that into account in believing his testimony.

Seems like the defendant is a genuine businessman. Sometimes employees like to cut corners and cross their fingers nothing goes wrong. Sucks it falls on him. But I feel like they really tried to milk an unfortunate situation. He was honest throughout the case, I hope his business isn't hurt by this.

These people are definitely money hungry.
The defendant came back and did what he should have done. With the exception of not paying the dumpster and little plastic parts on pool cover, he did whats right. The plaintiffs just got greedy. How did a short wall falling damage the landscaping? Their lawn looks half dead already, just like their "all year round bushes".

I totally disagree with the $1700 they received for lawn repairs. The dead bush was evidence that the lawn wasn't in the best condition. They milked the lawsuit which is horrible character on their part.

The Plaintiffs really over reached in their suit - Greed motivated them to seek much more then they deserved.

I think the guy was generous in coming back and fixed it after 5 years. You don't know if someone above this pool had landscaping fine which causes more rain. They should of built a higher retaining wall. Asking for everything brand new pool cover isn't fair that cover was 5 years old . I think having him repair the wall is all that they were owed

Plaintiff kept saying cylinder blocks. I'm surprised the judge didn't correct her. I'm glad she got busted trying to get compensated for dead and nonexistent bushes.

The defendant walked out of court with his reputation intact and perhaps even better than before. He honestly answered all questions even while knowing that it would not be in his best interest.
As for the plaintiffs, it is obvious that she wears the pants in that house.
