Regardless of the fact that you can pirate through emulation, a lot of data sets forget that the people who pirate probably weren't going to buy the game anyway.
If Nintendo were to sell their games on third party platforms instead of purely restricting it to their consoles there would be less pirating.
These big companies fail to understand that you can't win the audience by strong-arming them to purchase copies in one specific way. You win by providing options they would want.

I 100% am on board with having emulation be a thing and I'd even argue that it is flat-out needed for a industry like this, games and consoles don't last forever and at a certain point some games are almost completely impossible to play due to being rare or some other reason like online servers being shut down. I believe it's a great thing that fans can come together and make these games playable in a convenient place and give players a sense of freedom with a lot of the benefits emulation can provide. That being said, I do not condone piracy in most situations especially in this case with modern switch games but emulation itself is very much in a weird grey-area. There's been evidence to suggest it's ok and other evidence to suggest it isn't (like the recent nintendo and Yuzu stuff for example) and I feel like there should be a clear line for something like this since I personally believe emulation and preservation is important and there should be a clear way to keep that without having to be worried if it's gonna be a weird thing morally/legally.

People "pirate" Switch games mostly because they don't actually own a Switch. I had to emulate Metroid Dread myself as I did't own a Switch and didn't want to buy an entire console just to play one game. It's one of the reasons why I don't care for platform exclusives these days, I would have gladly bought a PC version of the game but they didn't provide one. I think lot of people felt the same way for games like Tears of the Kingdom. Nintendo is so stuck in the past that they can't accept that they would probably make more money selling games on PC instead of locking their games to an under powered handheld.

to me, emulation is much more justifiable when the hardware being emulated isn't being officially sold anymore. with an emulator for hardware that is still being officially sold, the use of the emulator may impact the sales of the official hardware, and from that perspective i can understand why nintendo would want a switch emulator to be shut down. not saying i'm siding with nintendo on this situation, but i understand why they would do such a thing.

This website, whilst certainly appearing official, is questionably associated with the official primary .dev domain (perhaps nintentionally.. see what i did there?) - I just wanted to clarify for the sake of accuracy. that shader cache thing is the only reason i dont use any switch emulators, i actually want to play the game not build credit to have the game play "better"

It applies if they take it from you like the digital media, but any nintendo game if you didnt buy it you dont have it, and now its not available, but they didnt take it away from you like ubisoft...(everyone is excusing piracy like this when they never bought a copy ever).

I knew this would happen, when I was told Nintendo took down the emu, I commented that I would give it 1 week till Nuzu, goozu, boozu, Duzu and Puzu would come out lol

Personally, most of (if not all) laws are just made to keep monopolies in power, the richer perpetually rich, and everyone else compliant.
I don't care about laws (cause they don't care about us). I care about ethics. I care about not being an ass to the everyday person.
Everyday workers should have infinitely more respect then these stupid monopolies.
I say all that as a person that won't hesitate to pay full price for a game I like. But all the same, emulation is justified. And honestly, I could care less if it wasn't.

My personal stance is that piracy is bad until A. The company fails to preserve the media, B. The company attacks their userbase for unjust reasons (ahem NINTENDO), or C. The content is not available for physical purchase and thus future preservation.

SUYU lasted til the 1st public release . They got hit by a DMCA and it was removed from GitLab . Whoever told Nintendo about the internet is goin to rue the day

Honestly, if Nintendo and other game companies put out their own official emulators and had official game sales for them... They could make serious bank. Their consoles are sold at a loss anyways, so why not? Most of their money comes from software sales, and there are plenty of people who pirate these games just because they literally have no other way to enjoy them. Many people, myself included, would be willing to buy the game if there was actually any way for us to do so (without dropping hundreds on another console we don't even want)
If I want a single game exclusively on Xbox and buy an XBSX and the game, Microsoft is at a loss of $140+. I have to buy four $60 games at full price for Microsoft to turn a $40 profit on forcing me to get one of their consoles (actually, I would have to buy even more because Microsoft doesn't get all of the money from that, but I'm sticking with it for simplicity sake). But if I had an official emulator - or even just a PC release - and could officially buy the game, Microsoft would get a $60 profit from the first game. And every one after that. But no, I'm out $500 extra dollars, and they made even less money off of me than they could have. They would make $200 more dollars off of me from those same four sales if they put out an official emulator. And PLENTY more from the countless people who won't ever cave and buy the console just to play a couple exclusive games We save more money (and in turn have more money to spend), they make more money, everybody wins

One of the problems with the Switch is that many games released on it don't run very well on it. Even Animal Crossing is struggling to run at 30 fps.

I can't buy switch cause they don't have it here or other Nintendo games so I emulate if they sold the games for pc I would've bought it instead of emulating it.

Me buying a knife gives me the power to commit a crime too. That is not illegal.
The illegal part is JUST distributing Iso/Rom/keys.
That's it.
Owning an emulator is not illegal, using an emulator is not illegal, owning an Iso of a game you own is not illegal, or of one you do not own is also not illegal.
These are all things that developers use, and they do not have special privileges.
And it is necessary for archiving, research and personal ownership.
The thing that IS potentially illegal, is breaking the nintendo T&C, but if you buy a physical card and load it on a computer, there isn't a T&C.
Nintendo is just wrong, and they need to stop this tirade against emulation.
