I work at a hospital as a nurse. I have an open claim with work comp for a knee injury. I received a letter from my employer to apply for FMLA but the work comp people sent me a email to tell me that I do not need to apply for FMLA. At the same time I am afraid that my work position will be taken away from me when I return to work. I only work week ends but get paid for a third day, a position that many want to have and that took me years to get. I understand that FMLA is only good for 12 weeks. Is it possible to apply for FMLA while being on work comp?

Also, I was put on light duty for 2 days after seeing the work comp doctor, during those two days I worked the same exact job as before because the NP said I could return back to work if I wanted as long as I followed the restrictions, elevating my leg 3 times in a 12 hour shift ( on my own lunch break time divided by 3), and up as tolerated, which is impossible to do when you care for patient, I walked for an entire 12 hour shift on my bad knee and performed the same as all the other nurses but at the end of my shift I was in a lot of pain. I did not get my paid fir the third shift even if I did the same work I always did. Any good attorney here in Missouri? Thanks!!

I want to see my doctor and she said I was not ready to go back to work but then I told her that worksman comp case worker tell me that I had to tell my doctor that she had to put me back to work without work resistance my doctor said if they want you back to work you're going to have to be in light duty and wear your body brace. And when I talk . Where's my case manager from workman's comp I told her that my doctor said that the only way I will be able to go to work is by restrictions only with body brace.

If I’m clear for light duty can I ask my employer for a reasonable accommodation and if they denied it can I sue my employer?

Thank you for all the info, but I am confused on having two different doctors, when you say their doctors and your doctor I guess you are saying that I can consult with my own doctor?? I have been told that I should not get my own doctor because my health insurance will not pay them and work compensation will only pay for their chosen doctor. So I will have to pay for my own doctor correct?
