Over the weekend a major gameplay leak appeared online showcasing in development footage of an anticipated title from EA. Nintendo has been under fire for the Joy Con drift situation, but now it looks like they actually have won a court case against the issue.

I’ve never understood how it’s legal to work into an End User Agreement, forcing people to forgo a basic right just to use the service, software, etc.
I don’t understand why nothing has ever been done about that.

These arbitration clauses need to end as they only serve to shield companies from accountability.

I still have a hard time trying to comprehend (short of 'they paid me to look at it this way') how contracts of adhesion forcing users to sign away their rights, often with said user not even understanding what has been signed away, are considered to be even REMOTELY legal, let alone enforceable. The whole original purpose behind formalized contracts was to create a roughly even playing field between two unequal parties, with an unbiased third party acting as a mediator. Contracts of adhesion, in and of themselves, go against every aspect of that right out of the gate.
Just more of the US legal system refusing to do it's job, I suppose.

It's so corrupt that digital assets can force into the contract a waver against lawsuits. This goes double for childrens toys. Like, you don't have this kind of contracts forced into strictly physical assets. Idk why the rules get to change just because it's digital.

The current spate of live service shutdowns re-affirms my disdain for single-player games with online requirements.
As soon as I learn a game requires you to log in online in order to play, I give it a hard pass.
As much as I was looking forward to GT 7, for example, the online situation put me off from buying it.

In a few years we'll look back on the barrage of so many live service games as a failed experiment. Sure there's a few examples of it working but so much money has been wasted on 95% of the live service games that have come out in the past 5 years.
