One of the biggest concerns during a divorce is how property will be divided. How can you protect your assets and ensure a fair outcome? In this informative episode, I speak with renowned Divorce Lawyer Vandana Shah to discuss the complexities of property division during divorce in India.

We delve into the different types of property – separate property, marital property, and inherited property – and explain how each is treated under Indian law. Lawyer Shah provides expert legal insights on how to document ownership, protect your assets, and navigate the legal process of property division.

While focusing on property protection, we also discuss the rising divorce rates in India and the various contributing factors, such as domestic violence, infidelity, and gender inequality within the legal system. We explore how these factors can influence property division outcomes.

Lawyer Shah offers valuable legal advice on other key aspects of divorce, including alimony, child custody arrangements, pre-nuptial agreements, and the legal procedures involved. We also touch upon the complexities of celebrity divorce cases and debunk common myths surrounding divorce in India.

The recent tragic case of Atul Subhash is handled with sensitivity, acknowledging the emotional and financial pressures that can accompany divorce, including disputes over property.

Plus, we have a rapid-fire round with Lawyer Shah, where she answers some key questions about the Indian legal system and the Supreme Court.

I think men and society should not even expect women to give up and compromise, if they ask her then they should tell how are they compensating her, .else in this a talented and hard working woman is just used by in laws and husband

I am a lady as well, I just want to talk about those women who marry a guy only for money. Now a days there is a trend in india, that a girl marry a guy and after in a year or two they files divorce and ask for healthy amount for that. And also judge allow them to settle in 5 to 50 lacs. How can you give money to a lady who didn't stay with you. Don't you think that's unfair to a men?

This generation talks so much about hard work and equality, but they do not know anything about both. Nothing in the world comes for free.If you work hard to earn a few lakhs similarly you need to invest physically and emotionally in a relationship. Husband is not your father, and wife is not your mom who will work for you without expectations. Like everything else in the world, no pain, no gain in marriage.

If husband asks for divorce but wife is not willing, then husband should give alimony, but if husband is not wanting a divorce and wife wants a divorce, then wife must give alimony. It should be fair

Let everything be on the paper before marriage in case something happens. In this case no one will feel cheated. On the other hand If a woman has devoted herself whole heartedly to the family and hasn’t made any career due to this responsibility then definitely she needs compensation to spend life alone. I have seen so many women who were not allowed to work with plea that looking after the house is also a full time job. Then why shouldn’t she get some money ? Mainly I am talking about the women who have spent 7-8 years in the marriage and have crossed the career building age.

I'm a divorcee myself & want to shed some light on this aspect. Let's get it square & clear that society is dominated by men undoubtedly & most of the women support this dominance. Exceptional cases like Atul Subhash are there everywhere, but let's speak on the majority. Marriage is a union. Having joint account, fixed deposits etc with wife is not a crime. Our parents never deserted our mom's on this aspect. Our mom never deserted/blackmailed their husband's on this aspect. Men who refrains to have joint accounts with wife but with their mom, is a big Red flag.

Ye baat galat hai ...agar shaadi ke naam par aap ek larki ko uske ghar se nikaal rahe ho to usko ghar dena aapka farz hai ...aur agar aap nahi dena chahte to fir larki ke saath sone ki ichcha mat paalo ...so saa ke chor do larki aur bachcho ko raaste par ..ye galat hai ...jabki aapko achchi tarah pata hai ki maayke waale larki aur bachcho ko divorce ke baad rakhna pasand nahi karte ...
