The Steps of the EB-3 Process

The EB-3 process has multiple steps that you need to go through to reach the final step of green card approval.

There are 3 main parts you need to understand the journey the Labor Certificate, the I-140 petition and then your visa application.

Step 1: Labor Certification - The employer must obtain a labor certification from the U.S. Department of Labor (DOL). This process ensures that there are no qualified U.S. workers available to fill the position being offered to the foreign applicant.

Step 2: Form I-140 Petition - Once the labor certification is approved, the employer files Form I-140, Immigrant Petition for Alien Worker, with the U.S. Citizenship and Immigration Services (USCIS). This form confirms that the employer is sponsoring the foreign worker for the EB-3 Visa.

Step 3: Visa Application - After the Form I-140 is approved, the foreign worker can apply for the EB-3 Visa at a U.S. embassy or consulate in their home country.
